WEBSITE USAGE AGREEMENT

THE USER

Access to this Site is provided to you, the User, subject to the following terms and conditions which may be updated by us from time to time. Also, use of certain areas of the Site is subject to additional posted guidelines or rules applicable to such areas, and those guidelines or rules are hereby incorporated by reference into these terms and conditions.

1. GlobalFN maintains this web site at http://www.globalfn.org (the "Gateway Site") as a courtesy to those who may choose to access the Gateway Site ("Users").
   
2. USE OF SITE CONTENT: The Gateway Site contains information, text, graphics, software algorithms, and other content (the "Site Content"). Most of the material found in the pages of the Gateway Site is protected under the copyright laws of the United States and of other countries. Unless otherwise indicated on a particular page users are welcome to copy the Site Content for User's personal, non-commercial use, without any right to resell the Site Content. Some Site Content has been submitted by the Gateway's partners, Users, and by third parties, and may be subject to more specific restrictions, as indicated on that content.
   
3. TRADEMARKS AND LOGOS: Site Content does not include certain names, words, titles, phrases, logos, icons, graphics or designs in the pages of the Gateway Site that are trade names, trademarks or service marks of GlobalFN, or of other entities which given permission to GlobalFN to use or display such marks. The display of trademarks, trade names or service marks on the Gateway Site does not mean that Users may use those names or marks in a way that would infringe on the rights of the owner of the marks.
   
4. DISCLAIMER OF WARRANTIES: While GlobalFN endeavors to provide current and accurate information, Site Content is provided "as is" and "as available". GlobalFN does not warrant the accuracy, completeness, or currency of the Site Content. GlobalFN expressly disclaims any and all warranties of any kind, including but not limited to implied, express or statutory warranties as to non-infringement of intellectual property rights, or third party rights, title, latent defects, uninterrupted service, merchantability, fitness for a particular purpose and freedom from computer viruses.
   
5. DISCLAIMER OF LIABILITY: In no event will GlobalFN be liable to you for any damages, including without limitation, direct or indirect, special incidental, moral or consequential damages, loss of profits, opportunities or information or for expenses arising in connection with your use of the Gateway Site or the Site Content. even if GlobalFN is advised of the possibility of such damages, losses or expenses.
   
6. DISCLAIMER OF ENDORSEMENTS: The Gateway Site contains links to third-party web sites. The linked sites are not under the control of GlobalFN, and GlobalFN is not responsible for the contents of any linked site or any link contained in a linked site. The appearance on the Gateway Site of the name or logo of another entity, or the appearance of a link to another entity's site, does not indicate endorsement by GlobalFN of the other entity or its products and services, and GlobalFN expressly disclaims any such endorsement.
   
7. FORUMS AND DISCUSSION GROUPS: The Gateway Site may contain bulletin boards, discussion groups, chat rooms, or other message or communication facilities (collectively, "Forums"). User agrees to use the Forums only to send and receive messages and material that are proper and related to the particular Forum. By way of example, and not as a limitation, User agrees that when using a Forum, User shall not do any of the following:
   1. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
   2. Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information.
   3. Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
   4. Upload or attach files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
   5. Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded.
   6. Falsify the origin or source of software or other material contained in a file that is uploaded.
      
8. BUSINESS FACILITATION TOOLBOX & OPEN SPACE: The Gateway Site may files that are uploaded by GlobalFN as well as individual members bulletin boards, discussion groups, chat rooms, or other message or communication facilities (collectively, "Forums"). User agrees to use the Forums only to send and receive messages and material that are proper and related to the particular Forum. By way of example, and not as a limitation, User agrees that when using a Forum, User shall not do any of the following:
   1. Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
   2. Upload viruses
   3. Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded.
   4. Falsify the origin or source of software or other material contained in a file that is uploaded.
      
9. User acknowledges that all Forums are public and not private communications. Further, User acknowledges that chats, postings, conferences, e-mails and other communications by other users are not endorsed by GlobalFN and such communications shall not be considered reviewed, screened, or approved by GlobalFN. GlobalFN reserves the right for any reason to remove without notice any contents of the Forums received from Users, including without limitation e-mail and bulletin board postings. User grants GlobalFN and its affiliates the right to edit, copy, publish and distribute any information or content User posts or transmits to the Gateway for any purpose and without compensation to User.
   
10. User acknowledges that all Forums are public and not private communications. 11. This Agreement will be interpreted and enforced in accordance with the laws of the European Community.
